AutoSpect provides an informational guidance framework for vehicle inspections. Final vehicle purchase decisions, financial commitments, and mechanical verifications are the sole and exclusive responsibility of the buyer.

1. Contractual Relationship & Acceptance of Terms

By downloading, installing, or using the AutoSpect mobile application ("the App"), you agree to be bound by these Terms of Service and Disclaimers. If you do not agree to these terms, do not use the App.

You acknowledge that these Terms are concluded solely between you and AutoSpect, and not with Apple, Inc. AutoSpect, not Apple, is solely responsible for the App, its infrastructure, and its content.

2. Nature of the Service

AutoSpect is an informational data-aggregation utility designed to assist private car buyers in organising and interpreting publicly available vehicle data, historical MOT maintenance summaries, and probabilistic, model-specific insights generated by large language models (LLMs). The App does not constitute and must not be relied upon as:

  • A professional mechanical vehicle inspection or engineer's report
  • Legal or financial advice regarding any vehicle marketplace transaction
  • A statutory guarantee of vehicle condition, roadworthiness, valuation, or structural safety
  • A substitute for an in-person, physical inspection conducted by a qualified automotive mechanic

3. Exclusion of Liability

To the maximum extent permitted by the laws of England and Wales, AutoSpect and its individual operators shall not be liable to you in contract, tort (including negligence), or otherwise for any direct, indirect, incidental, or consequential financial losses, damages, or repair expenses arising from:

  • Your reliance on any data analytics, automated inspection checklists, metadata scores, or diagnostic suggestions produced by the App
  • The physical purchase, non-purchase, mechanical breakdown, or subsequent road condition of any vehicle
  • Any structural inaccuracies, systemic outages, or outdated parameters present in third-party vehicle registries or DVLA-connected data feeds
  • AI-generated insights that are incomplete, outdated, or contextually misleading

4. Limitation of Liability & Statutory Carve-Out

Nothing in these Terms shall limit or exclude AutoSpect's liability for:

  • Death or personal injury caused by our proven negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be lawfully excluded or limited under the laws of England and Wales

Subject to the above, our total cumulative liability to you for any claim arising out of or related to your use of the App shall not exceed the exact price paid by you for the relevant in-app purchase, or £15 where no purchase was made.

5. In-App Purchases & Refund Policy

Transactions and digital item purchases are processed entirely through Apple's App Store payment infrastructure using StoreKit. AutoSpect never receives or stores your payment card details or Apple ID. Purchase transactions are securely validated directly on your device using Apple's signed cryptographic frameworks.

As digital consumer products, purchases are considered fully consumed once an automated vehicle report data payload has been generated. Refund requests must be managed and requested directly through Apple's native App Store billing interface.

Nothing in this policy restricts, limits, or excludes your statutory consumer rights under the UK Consumer Rights Act 2015 regarding digital content that is proven to be faulty or misdescribed.

6. Third-Party Data & AI Disclaimers

Vehicle history, MOT parameters, and specifications are retrieved via public APIs connected to UK transport registries. AutoSpect does not warrant the ongoing accuracy or availability of external public records. Users should independently verify critical information before making any financial commitment.

All automated checklists, fault pattern suggestions, and buyer question guides are probabilistic computations delivered by generative large language models. They are provided solely as an open-ended framework to aid your personal research and must not be treated as definitive or infallible diagnoses.

7. Maintenance, Support & Product Claims

AutoSpect is solely responsible for providing any software maintenance or product support for the application. Apple, Inc. has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

AutoSpect, and not Apple, is responsible for addressing any user or third-party claims relating to the possession or use of the App, including but not limited to product liability claims, regulatory compliance failures, or intellectual property infringement claims.

8. Intellectual Property

All content, branding, software, and design within the App are the intellectual property of AutoSpect and its operators. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Governing Law & Jurisdiction

These Terms, their subject matter, and their formation are governed exclusively by the laws of England and Wales. You and AutoSpect agree that the courts of England and Wales shall have exclusive jurisdiction over any legal disputes arising under this agreement.

10. Changes to These Terms

We reserve the right to update these Terms at any time. The "Last updated" date will reflect the most recent revision. Where changes are material, we will notify you within the app before they take effect.
